Terms And Contitions

Rentals Ts & Cs

  • All payments to be settled in full before any services are supplied.
  • Blackball works on a first come first serve basis, only signed agreements and proof of payment will result in a confirmed booking.
  • Please ensure that the confirmations are recorded and acknowledged by a Blackball staff member.
  • Please ensure all information pertaining to your rental booking is correct on the invoice, no responsibility will be taken whatsoever for any changes or details
  • which appear incorrectly on the invoice / form.
  • No equipment will be left on site until security deposit and rental fees are paid in full.
  • Should the above requirements no be met, we reserve the right to cancel this booking without any notification to you.
  • While every effort will be made to ensure a successful function, we cannot accept responsibility for mechanical failure or otherwise
  • that is beyond our control.
  • In the event of the equipment becoming inoperative under circumstances for which the lessor is liable to restore same to an operative condition,
  • the lessor shall, without prejudice to its other rights, be entitled to substitute equipment for the leased equipment.
  • In the unfortunate event of cancellation by the client for whatever reason and provided that blackball is notified more than 72 hours (3 days) before
  • the starting time of the event, then a 25 % penalty of deposits/payments cancellation fee will apply.
  • should blackball  be notified on the day or after the starting time of the event,  then a 50% penalty of deposits/payments cancellation fee will apply.
  • Please note: deposits/payments made to blackball can be retained at the clients request as an advance deposit/payment for a future event.
  • Responsibility for theft and any damage lies with the lessee whilst in their possession.
  • Client to supply adequate power for the hired equipment.
  • Refundable deposits not claimed within 1 years of rental date will be forfeited.
  • If equipment becomes inoperative and clients do not log calls timeously with a technician no refunds or credits will be passed.
  • Blackball requires close parking and easy access on all deliveries unless agreed in writing prior to installation.
  • Please ensure steps and long distances for delivery are specified prior to delivery.

Sales Ts & Cs

PLEASE NOTE THE FOLLOWING IMPORTANT TERMS AND CONDITIONS:

  • 50 % deposit  confirms your order unless otherwise agreed by the management
  • Balance due prior to delivery/collection of goods
  • All access to property must be clearly specified as we require close parking for all delivery/installations -Steps, Long Distances and Gates in particular must be specified and billed for accordingly.
  • Production time is approximately 3 to 4 weeks from date of deposit received unless otherwise quoted by management
  • We work on a first come first serve basis, any special/rush orders will incur extra costs and will be subject to availability
  • We give a limited 6 (six) Month Warranty on all working parts of our products provided that faults are caused from our manufacturing process and we reserve the right to replace same.
  • Ownership of the goods will only pass when full payment is received.
  • Any cancellation of a placed order will be subject to a 20% (Twenty) percent cancellation fee if acceptable to management.

Custom-made Items Ts & Cs

(South Africa – CPA Aligned)

1. Custom-Made / Bespoke Items
1.1 All goods manufactured to a client’s specifications are deemed custom-made.
1.2 Custom-made goods cannot be cancelled or refunded once production has commenced, except where required by the Consumer Protection Act (CPA).
1.3 Minor cosmetic variations or tolerances inherent to handcrafted or custom manufacturing do not constitute defects.

2. Quotations & Scope of Work
2.1 Quotations clearly specify whether pricing includes:

  • Manufacture
  • Transport
  • Installation

2.2 Where installation is not expressly included, it is deemed excluded, and the client assumes full responsibility for handling and assembly.

3. Delivery & Risk
3.1 Goods are considered delivered in good order unless damage is noted in writing at the time of delivery.
3.2 Risk passes to the client upon delivery.
3.3 The supplier is not liable for damage occurring after delivery, including during handling, storage, or installation.

4. Installation & Handling
4.1 Where installation is not performed by the supplier, the client accepts full responsibility for:

  • Correct installation
  • Suitable manpower
  • Safe handling

4.2 The supplier shall not be liable for damage caused by:

  • Incorrect installation
  • Inadequate manpower
  • Misuse or mishandling

(as per Section 55(6) of the CPA).

5. Inspection & Complaints
5.1 The client must inspect goods immediately upon delivery.
5.2 Any defects must be reported in writing within 24 hours of delivery.
5.3 Complaints arising after handling or installation may require inspection before liability is determined.

6. Defects, Remedies & Refunds
6.1 In the event of a proven manufacturing defect existing at the time of delivery, the supplier may, at its discretion:

  • Repair the goods
  • Replace the goods
  • Partially refund the purchase price

6.2 A full refund will only be considered where:

  • A material defect is proven, and
  • Repair or replacement is not reasonably possible

6.3 Refunds are not available for damage caused by the client or third parties.

7. Returned Goods
7.1 Returned goods will be inspected prior to any refund decision.
7.2 Returned custom-made items may be subject to:

  • Handling fees
  • Depreciation
  • Repair or refurbishment costs

8. Goodwill Refunds
8.1 Any refund granted as a goodwill gesture is made without admission of liability.
8.2 A partial refund does not create an obligation for any further refund.

9. Limitation of Liability
9.1 The supplier’s liability is limited to the value of the goods supplied.
9.2 The supplier shall not be liable for indirect, consequential, or incidental damages.

10. Governing Law
10.1 These Terms & Conditions are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008.
